APPLICANT REQUESTS THAT:

Her records be corrected to reflect award of the Air Force 
Commendation Medal with one oak leaf cluster (AFCM w/1OLC).

APPLICANT CONTENDS THAT:

She received the AFCM w/1OLC because of her outstanding work at 
Taegu AB, South Korea.  The United States Assistant District 
Attorney at her Federal Court case told her and the judge that 
the AFCM w/1OLC would be added to her records.  The transcripts 
from the Medical Board Hearing include a list of her awards.

The applicant’s complete submission is at Exhibit A.

STATEMENT OF FACTS:

The applicant served in the Regular Air Force from 17 May 
1989 through 21 Aug 1998.

The remaining relevant facts pertaining to this application are 
contained in the letter prepared by the appropriate office of 
the Air Force.  Accordingly, there is no need to recite these 
facts in this Record of Proceedings.

AIR FORCE EVALUATION:

AFPC/DPSID recommends denial. DPSID states that the AFCM is 
awarded to members of the Armed Forces of the United States, 
below the grade of colonel and foreign military personnel who, 
while serving in any capacity with the Air Force after 24 Mar 
1958, shall have distinguished themselves by outstanding 
achievement or meritorious service.  DPSID was unable to locate 
a Special Order, signed certificate, or any official 
documentation verifying award of the AFCM w/1OLC.  The evidence 
in the medical board hearing is not official as it was compiled 
by the applicant.  Furthermore, the exhibit is not present in 
any case.  There was no documentation located for the Federal 
Court case the applicant says she initiated.  To grant the 
applicant relief would be contrary to the eligibility criteria 
established by DoDM 1348.33, Manual of Military Decorations and 
Awards and AFI 36-2803, The Air Force Awards and Decorations 
Program.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:

On 29 Oct 2013, a copy of the Air Force evaluation was 
forwarded to the applicant for review and comment within 
30 days.  As of this date, no response has been received by 
this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice.  We took notice 
of the applicant's complete submission in judging the merits of 
the case; however, we agree with the opinion and recommendation 
of the Air Force office of primary responsibility and adopt its 
rationale as the basis for our conclusion the applicant has not 
been the victim of an error or injustice.  Therefore, in the 
absence of evidence to the contrary, we find no basis to 
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
